Yes. Under WICA, your employee can claim compensation from you if they are injured in a work accident, including:
- Medical leave wages
- Medical expenses
- Lump sum compensations
You remain liable to pay compensation, even if the employee is terminated.
If employee starts work at a new company
An employee who starts work with a new employer while covered by medical leave (MC), hospitalisation leave or light duty for work injury sustained when working with the previous employer, is not entitled to medical leave wages as the new employer is not responsible for medical expenses related to the previous work injury.
However, the employee must still be reimbursed by the previous employer for medical expenses and be paid lump sum compensations if any, subject to the respective limits under WICA.
