If a company is carrying out retrenchment, how long a notice period should it give the union and affected workers?

The company should contact the union as soon as the retrenchment date has been decided, and no later than the notice period specified in the collective agreement with the union.

The notice period for employees should be spelt out in their employment contracts or agreed between the employer and employee. If not, the notice period stipulated in the Employment Act applies.
