Public Consultation on Proposed Enhancements to the Work Injury Compensation Act Framework

  1. The Ministry of Manpower (MOM) is inviting members of the public to give feedback on the proposed enhancements to the Work Injury Compensation Act (WICA) framework. A public consultation document, summarising the key features of the process, can be accessed at the REACH website (www.reach.gov.sg) over the next two weeks (27 Jan 2011 to 11 Feb 2011). MOM is also consulting industry stakeholders, including insurers, employer and employee representatives as part of the consultation exercise.

  2. The WICA provides a simple, low-cost and expeditious alternative to common law for employees to settle their work injury compensation claims. To claim compensation under WICA, an employee claiming under the Act only needs to show that his injury arose out of and in the course of his employment. He is not required to prove that his employer is at fault. The no-fault system and prescribed levels of compensation under WICA serve to facilitate and expedite the settling of claims.

MOM is proposing revisions to enhance the WICA framework, to (i) ensure that the WICA framework as a no-fault regime continues to strike a fair balance between compensation for employees and the obligations placed on employers; (ii) ensure the framework remains expeditious, so that parties can settle compensation claims without unnecessary delays; and (iii) ensure the clarity of insurance requirements under WICA. MOM welcomes all feedback to help ensure that the proposed WICA amendments strike a fair balance between compensation for injured employees and the obligations placed on employers, and that WICA continues to be a simple, low-cost and expeditious method of resolving claims for work-related injuries.
