Work Permit - Before you apply

Blacklisting

MOM will debar employers who are deemed unsuitable to employ foreign workers. Employers who are debarred will not be allowed to apply work passes for new foreign workers, as well as renew the work passes of their existing foreign workers. This includes Work Permit, S Pass and Employment Pass holders.

Such employers would have committed infringements of the various rules and regulations under MOM's purview. This includes the Employment of Foreign Manpower Act, Employment Act and Workplace Safety and Health Act. MOM will also take into consideration ongoing investigations against employers for such offences when they apply for new work passes, or renew existing work passes.

An employer will be debarred from hiring foreign workers if he is found to have committed offences such as:

  • Physical and/or psychological abuse of workers.
  • Deliberately attempting to cover up fatal or serious accidents, e.g. removing the injured or deceased from the scene of accident.
  • Repeated convictions under the Workplace Safety and Health Act (WSHA) for accidents that have resulted in fatalities (Under section 51 of the WSHA).
  • Deliberately defying a Stop Work Order and allowing workers to continue working without rectifying unsafe working conditions.
  • Illegally employing or deploying foreign workers.
  • Exploitation of foreign workers, for example:

      - Failing to pay workers' salary; and/or

      - Failing to provide basic employment benefits under the Employment Act, such as annual leave, public holiday and rest day.
  • Committing fraudulent acts with the intent to deceive the Controller of Work Passes to obtain work passes which would otherwise have not been issued. For example, forging of educational certificates, or deliberately falsifying information.

The period for which employers are debarred from hiring foreign workers is based on the severity of the offences committed. Individual employers will be informed of the period for which they are debarred. Employers who wish to appeal concerning their debarment can write to:
