Public Consultation on the Proposed Re-Employment Legislation

  1. The Ministry of Manpower (MOM) is inviting members of the public to give feedback on the proposed re-employment legislation. Members of the public may view the key features of the proposed re-employment legislation on the REACH website over the next two weeks (16 Sep 2010 to 29 Sep 2010) and provide their feedback through REACH. This public consultation exercise follows extensive discussions with the tripartite partners and stakeholders on the proposed re-employment legislation.

  2. In view of Singapore's ageing population and workforce, the Government announced in 2007 its intention to introduce the re-employment legislation by 2012. This will facilitate older employees working longer. Following the release of the Tripartite Guidelines on Re-employment of Older Employees ("Guidelines") in March 2010, MOM has been engaging the tripartite partners on the proposals for the re-employment legislation.
  3. The proposed re-employment legislation sets out the key conditions and obligations for re-employing older employees. The proposed re-employment legislation includes the following features:

    a) The eligibility criteria for re-employment,
    b) The requirements for employers to re-employ eligible older employees or offer Employment Assistance Payment (EAP) if they are unable to do so despite their best efforts, and
    c) The avenues for assistance and recourse in the event of re-employment disputes
  4. The tripartite partners have also provided an update to the Tripartite Guidelines to complement the proposals for the re-employment legislation. The proposed re-employment legislation should be read in conjunction with the draft Tripartite Guidelines which set out more detailed parameters for the implementation of re-employment by employers. Details can be found in the public consultation document. The proposals take into consideration the feedback and views from our tripartite partners.
  5. MOM welcomes all feedback and views on the key features of the proposed re-employment legislations. Following this public consultation exercise, MOM intends to enact the re-employment legislation in early 2011. This will allow sufficient lead time for employers, unions and employees to implement the necessary policies and processes for re-employment before the law comes into force in 2012.
