How can I be assured of the objectivity of permanent incapacity assessments if the assessing doctor is chosen by my employer or insurer?

There are safeguards under WICA to ensure that permanent incapacity assessments are fair.

Firstly, the Commissioner for Labour can allow an employee to change doctor if there are concerns and sufficient evidence that the quality of care and incapacity assessment by the employer’s doctor was not adequate or fair.

Secondly, employees can object to the assessment used to compute the compensation. They will be re-assessed by the WIC Medical Board, which comprises 2 senior consultants from restructured hospitals.
